Terms of Sale

These Terms of Sale constitute a legally binding agreement made between you and Techmart FZCO and govern the sale of products made available on the www.epson.ae website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (the 'Store'). By placing an order through the Store, you confirm that you have read, understood, and accepted these Terms.

1. About the Seller

For all orders placed through the Store, Techmart FZCO is the seller of record and your contractual counterparty. Techmart is responsible for accepting and fulfilling your orders, issuing invoices, collecting payments, arranging delivery, handling returns, deciding on refund eligibility, and issuing refunds.

For the purposes of these Terms:

'Seller / we / us / our' means Techmart FZCO, a company incorporated in the United Arab Emirates, with its principal place of business at S10915, South Zone 1, Jebel Ali Free Zone, Dubai, United Arab Emirates.

'Customer / you / your' means any end customer purchasing products through the Store for personal use or internal business use and not for resale.

'Store' means the online storefront accessible through www.epson.ae and any related UAE pages, interfaces, or applications through which the Seller offers products for sale.

2. Scope

These Terms apply to all products offered for sale by the Seller through the Store for delivery within the United Arab Emirates.

Separate website terms of use, privacy notices, warranty terms, campaign terms, or service-specific terms may also apply where relevant. In case of inconsistency, mandatory UAE consumer law will prevail over these Terms.

3. Eligibility and Territory

Orders may only be placed by persons legally capable of entering into binding contracts under applicable law. The Store is intended for delivery within the United Arab Emirates. Orders for delivery outside the UAE may be rejected.

Products sold through the Store are intended for end use only. Products may not be purchased for resale, export, or onward distribution. Orders that appear to be placed for resale, commercial redistribution, or export may be refused or cancelled.

4. Formation of Contract

When you complete the checkout process and submit your order, you make an offer to purchase the selected products from the Seller.

After submission, you will receive an order acknowledgement by email. This acknowledgement confirms receipt of your order request only and does not mean that your order has been accepted.

Acceptance occurs only when the products are dispatched and you are sent a dispatch confirmation email, at which point a binding contract is formed between you and the Seller.

If we are unable to accept your order, we will inform you and will not charge you, or will refund any amount already charged, as applicable.

5. Order Refusal or Cancellation by the Seller

We may refuse, limit, or cancel an order before dispatch for legitimate reasons including:

the product is unavailable or discontinued;

payment authorization fails or is declined;

pricing, product description, or listing errors;

suspected fraud, abuse, or unauthorized resale;

delivery address is incomplete, incorrect, or outside the UAE; or

the order would breach applicable law, sanctions, or these Terms.

If an order is cancelled after payment has been captured, the relevant amount will be refunded through the original payment method, unless otherwise required by applicable law.

6. Product Listings and Availability

Product images, descriptions, specifications, compatibility statements, and availability information on the Store are provided for general guidance only. Although reasonable efforts are made to ensure accuracy, actual products, packaging, included accessories, or documentation may vary slightly from website images or descriptions, including due to product updates or local requirements.

The Seller may change product listings, discontinue products, or adjust available quantities at any time before order acceptance.

7. Prices and VAT

All prices displayed on the Store are in UAE Dirhams (AED), unless otherwise stated.

Unless expressly stated otherwise, displayed prices include applicable UAE VAT and exclude any separately stated delivery charges or other fees. Any delivery charge or other payable amount will be shown to you before you submit your order.

We reserve the right to amend prices at any time before order acceptance. However, price changes will not affect accepted orders, except where there is an obvious and unmistakable pricing error that could reasonably have been recognised as such, in which case we may cancel the order and refund any amount you have paid.

8. Payment

We accept the payment methods shown on the Store at checkout. By placing an order, you confirm that the payment details provided are valid and that you are authorised to use the chosen payment method.

Payment will be authorised at the time the order is submitted and will be captured upon dispatch confirmation, unless a different payment workflow is specified at checkout for the relevant payment method.. We may use third-party payment service providers for processing payments. The Seller is the merchant of record and the sole recipient of customer payments for orders placed through the Store.

UAE-compliant electronic tax invoices will be issued to the Customer upon successful completion of each order, in accordance with applicable UAE VAT laws.

9. Delivery

We deliver only to addresses within the United Arab Emirates.

Estimated delivery times shown on the Store or in the dispatch confirmation are indicative only and are not guaranteed, although we will use reasonable efforts to meet them. Delivery may be subject to delays outside our reasonable control.

Delivery is completed when the products are delivered to the address you provided in your order. Risk in the products passes to you on delivery, except where otherwise required by mandatory law. Title to the products passes only when full payment has been received. We may deliver an order in multiple consignments (partial shipments). Each consignment will be treated as delivered when delivered to the address you provided, and risk passes on delivery of that consignment.

If delivery cannot be completed because you are unavailable, you refuse delivery, or access is not possible due to incorrect or incomplete address or contact details, we (or the carrier) may attempt re-delivery, hold the products for collection for a limited period, or return the products to us. Any reasonable re-delivery, storage, or return-to-sender costs and any additional handling charges may be charged to you where legally permissible provided that any such charges are disclosed to you in advance and do not exceed the actual cost incurred (see also Section 14).

You must inspect the package and products as soon as reasonably possible after delivery. If products are obviously damaged in transit, incorrect, or missing, you should notify customer service promptly and provide relevant details and evidence (e.g. photos).

10. Order Changes and Cancellation by the Customer Before Dispatch

You may request cancellation of an order until delivery processing has started, meaning before the order has been processed for dispatch or handed to the delivery carrier.

If your cancellation request is received in time and successfully processed, the order will be cancelled and any captured payment will be refunded to your original payment method.

Once delivery processing has started, the order can no longer be cancelled prior to delivery. In that case, any post-delivery rights will depend on these Terms and on any mandatory rights you may have under applicable UAE law.

11. Returns and Refunds Policy

11.1 General policy for non-defective products

If you change your mind, you may request a return of a non-defective product within fourteen (14) days of delivery, provided the product is unused, unopened (including any seal intact), not activated/installed/registered, and returned in its original packaging with all accessories and proof of purchase.

To exercise any retun or refund right, you must either use the 'request a return/refund' option in your customer account on the Store or send the Seller the Cancellation Form by email or other contact channel made available on the Store (a model Cancellation Form is provided at Annex 1 to these Terms of Sale), with the required details, identifying your name, order number, date of purchase, the relevant Service, and sufficient information for us to identify the order.

The Seller may refuse returns for non-defective products where the product box or seal has been opened, or where the product has been activated, installed, used, registered, damaged after delivery, or is not returned in the same condition in which it was delivered, subject always to your mandatory rights under UAE law.

The Customer shall be responsible for the cost of returning non-defective products to Techmart Middle East LLC, Warehouse No-6, Arenco warehouse, Dubai Investment Park-1, Dubai, United Arab Emirates. The return method and address will be confirmed by customer service upon the Customer's return request

11.2 Defective, damaged, incorrect, or non-conforming products

If a product is defective, damaged on delivery, not as described, not in conformity with the contract, or otherwise subject to a legal remedy under applicable UAE law, you may be entitled to repair, replacement, or refund, depending on the circumstances and the applicable legal requirements.

Nothing in these Terms limits or excludes any mandatory consumer rights under UAE law in relation to defective products, repair, replacement, refund, warranty performance, or product recalls.

11.3 No blanket exclusion of statutory rights

Any return limitation stated in these Terms applies only to non-defective goods and does not apply where you have a non-waivable statutory right under applicable law. If any clause is inconsistent with mandatory consumer law, it will be interpreted to the minimum extent necessary to remain compliant, and your statutory rights will prevail.

11.4 Refunds timeline

Where a refund is due in respect of a product, the Seller will process the refund within [30] days of the return being accepted and verified by the authorised service centre.

12. Return Process for Defective Products

Where you believe a product is defective:

Contact customer service within seven (7) days of delivery of the product (or such other period as required by UAE law) and provide your order number, product details, and a description of the problem.

You will be directed to an authorised service centre in the UAE for inspection and technical assessment.A list of Epson-authorised service centres in the UAE can be found below:

The authorised service centre will examine the product and determine whether the issue reflects a confirmed defect, misuse, accidental damage, normal wear and tear, consumable depletion, software/configuration issues, or no fault found.

If the product is confirmed to be defective and you are entitled to a remedy under applicable law or warranty, the Seller will provide the appropriate remedy, which may include repair, replacement, or refund, depending on the circumstances and legal requirements.

If the service centre determines that the product is not defective, the Seller may reject the return request and no refund will be due.

13. Warranty and After-Sales Support

Products sold through the Store benefit from any applicable manufacturer's warranty and any mandatory statutory warranty protections under UAE law.

Warranty details, including duration, coverage and exclusions, are normally provided in the product documentation, on the warranty card, or in the manufacturer's warranty terms. Where applicable, you may be directed to the relevant authorised service network or support channels for diagnosis, repair, or warranty handling.

If the product cannot be repaired within timelines required by UAE law in circumstances where you are legally entitled to an alternative product or compensation, the legally required remedy will apply unless the defect arose from your conduct.

Customers may also purchase extended warranty and service coverage for eligible products through Epson CoverPlus, which is available separately through the Store. CoverPlus is subject to separate Terms and Conditions

14. Customer Obligations

You must use the products in accordance with the manufacturer's instructions, safety notices, and any installation or compatibility guidance. You should keep proof of purchase and, where possible, original serial numbers and packaging for support and warranty purposes.

You are responsible for ensuring that the delivery address and contact details you provide are accurate and complete. Additional charges or delays resulting from incorrect or incomplete information may be charged to you where legally permissible.

15. Product Safety and Recalls

If any product is identified as having a defect affecting efficiency, effectiveness, or safety, the legally required obligations under UAE law will apply, which may include notifying customers, withdrawing or recalling affected products, and offering repair, replacement, or refund as required.

Returned or withdrawn defective products must not be resold or re-displayed on electronic sales platforms.

16. Force Majeure

Neither party will be liable for any delay or failure to perform its obligations under these Terms to the extent caused by events beyond its reasonable control (a “Force Majeure Event”), including courier or transportation disruption, customs restrictions, supply chain disruption, and system outages or other technical issues. Any delivery or performance timelines affected by a Force Majeure Event will be extended for the duration of the Force Majeure Event.

17. Limitation of Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability for fraud, gross negligence, death or personal injury caused by negligence, defective products, or non-waivable consumer rights.

Subject to the foregoing and to the maximum extent permitted by law, the Seller will not be liable for indirect or consequential losses arising out of or in connection with your purchase or use of the products.

18. Data Protection

Personal data collected through the Store will be processed in accordance with the applicable privacy notice and relevant UAE data protection requirements. Personal data collected through the Store in connection with your order, payment, delivery, and after-sales support will be processed by Techmart FZCO as data controller for those purposes, in accordance with the Privacy Information Statement published on the Store and applicable UAE data protection law. Techmart will take appropriate technical and organisational measures to protect your personal data and will not use it for marketing or promotional purposes without your consent

19. Website Use and Terms of Use

Your access to and use of the www.epson.ae website (including browsing, account creation and use of site content) is governed by the separate Terms of Use and related legal notices made available on the website.

20. Intellectual Property and Platform

All intellectual property rights in the Store, including the domain name, platform, design, trademarks, logos, product content, photographs, text, graphics, software, and other materials, as governed by the Terms of Use, are owned by their respective rights holders and are not transferred to you by any sale of products through the Store.

You may not copy, reproduce, or use any part of the Store or its content except as permitted by law or by express written permission from the relevant rights holder.

21. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with your purchase from the Store shall be governed by the laws of the United Arab Emirates, without prejudice to any mandatory protections that may apply to you as a consumer to exercising any right to file a complaint with the competent consumer protection authority or to bring a claim before the courts of the United Arab Emirates .

The courts of Dubai shall have jurisdiction over any such dispute, unless mandatory law requires otherwise.

22. Language

These Terms are available in English and Arabic. If there is any inconsistency between language versions, the Arabic version will prevail to the extent required by applicable UAE law.
